Service description
Tapsela (tapsela.com) is an appointment management platform for self-employed specialists. The booking surface (book.tapsela.com) lets Specialists' Clients book and manage appointments. Some features are in early development and may change; this concerns feature availability, not Tapsela's legal obligations to users.
No warranty
To the maximum extent permitted by law the service is provided "as is". We do not guarantee that the service will be uninterrupted, error-free, secure or fit for the particular needs of a business. The above does not exclude or limit liability that cannot be excluded or limited under applicable law.
User responsibility
The Specialist bears full responsibility for Client data and communications. When sending messages through the service the Specialist is responsible for legal compliance, including legal basis, any required consents, and respecting Client preferences.
Limitation of liability
Subject to mandatory law, Tapsela is not liable for indirect damage, message delivery failures or consequences of using the service exceeding the amounts paid by the user in the 12 months preceding the harmful event.
Acceptable use
You may not use the service for spam, unlawful activity or abuse, including for sending marketing communications without valid recipient consent.
Account suspension
We may suspend, restrict or terminate access to the service in case of breach of these Terms, unlawful use of the service or activity creating risk for us or other users. Where appropriate we will provide prior notice and an opportunity to cure.
Persons under 16
The service is not intended for persons under 16. Specialists should not register or schedule Clients under 16 without explicit consent of a parent or legal guardian booking on their behalf.
Governing law and jurisdiction
These Terms are governed by Polish law, in particular the Civil Code (Act of 23 April 1964) and the Act of 18 July 2002 on the provision of services by electronic means. Any disputes under these Terms are resolved by the court competent under art. 31 et seq. of the Polish Code of Civil Procedure. Consumers retain the right to use out-of-court dispute resolution, including the European Commission's ODR platform at https://ec.europa.eu/consumers/odr.
Changes to these Terms
We may update these Terms. We will notify you of material changes at least 14 days in advance via the service or email. Continued use after the changes take effect constitutes acceptance.
